Pedestrian Accidents in Pennsylvania

Pedestrian-related crashes represent a small percentage of total reported traffic crashes in Pennsylvania, but they account for a sizable portion of traffic fatalities. In Pennsylvania, personal injury protection (PIP) is a mandatory coverage for all drivers. This coverage is also available to injured pedestrians. However, not all pedestrians have an insurance policy or enough insurance coverage. In this case, victims may be able to use a family member’ policy or file a claim with the at-fault driver’s insurance company. According to Pennsylvania’s statute of limitations, pedestrians have two years to file a claim from the date of injury. Claims made after this time are commonly dismissed. In 2017, there were 150 pedestrian fatalities in Pennsylvania. If an accident results in death, a wrongful death claim may be a viable option for surviving family members.

Compensation Available to Victims

Injured pedestrians may be entitled to compensation. This is true regardless of what type of insurance (i.e., full tort or limited tort) the victim has at the time of the accident. Pedestrian accidents are one of six non-injury related exceptions that allow a victim to step outside limited-tort insurance restrictions. In addition to economic damages, victims may also seek noneconomic compensation.
  • Economic damages – medical bills, lost wages, loss of earning potential, medical equipment, etc.
  • Noneconomic damages – pain and suffering, mental anguish, loss of consortium, etc.
In some cases, victims may be eligible to recover punitive damages as well. Compensation is available to victims who can prove the other driver’s negligence caused the injury. Proving fault typically involves eyewitnesses, expert testimony, surveillance recordings, medical records, police reports, and so on. Victims can share fault, but are not necessarily barred from recovering damages due to Pennsylvania comparative negligence laws. If, for example, the pedestrian was jaywalking when the crash occurred, they may share fault and compensation will be reduced proportionally. Our experienced injury lawyers will work hard to protect your rights and prove your claim. You and your loved ones shouldn’t have to struggle because of someone else’s negligence.
